Ernestina Godoy is rejected as Prosecutor of CDMX

With 41 votes in favor and 25 against, the Congress of Mexico City agreed not to ratify Godoy in office.

Ernestina Godoy Ramos will not repeat as prosecutor of Mexico City. With 41 votes in favor and 25 against, the local Congress agreed not to ratify her in office.

Tomorrow, Tuesday, January 9, is Godoy’s last day of work. Mexico City prosecutors serve four years in office and have the right to serve for an equal period.

Now, the Organic Law of the Prosecutor’s Office dictates that the Board of Directors of Congress must notify the Citizen Judicial Council of the decision so that it issues a new call to elect the new prosecutor.

The Citizen Judicial Council must propose, with the approval of two-thirds of its members, a shortlist of candidates for the head of GovernmentMartí Batres will have to refer someone from that shortlist to Congress.

According to the organic law of CongressBatres has 15 calendar days to send the designation proposal to the deputies.

This proposal must reach the Congressional Justice Administration and Prosecution Commission. Once received, the commission has 24 hours to call a session. You then have a maximum of five calendar days to interview the proposed person.

Once the interview has been carried out, the Commission must declare itself in a permanent session and will meet the next day to analyze, study, discuss, and vote on the proposal.

If they approve it, they will return it to the Board of Directors to vote on it in a plenary session. The Organic Law of Congress establishes that if the ordinary period has been exhausted, an extraordinary period must be called immediately.

Congress will appoint the new prosecutor by a qualified majority: two-thirds of the deputies present.

If it is not approved, the process will be repeated until the majority is achieved.
