The lawyer’s request seeks to throw out the guilty verdict handed down on February 21, so that a new trial can occur.
Genaro García Luna, former Secretary of Public Security of Mexico, requested a new trial from the judge who is handling his marriage in the United States, Brian Cogan.
The request was presented to César de Castro, the lawyer of the former official convicted of drug trafficking in that country and who is awaiting his sentence.
“The defendant Genaro García Luna appears before the Honorable United States District Judge Brian M. Cogan in a court of the United States for the Eastern District of New York, for an order vacating García Luna’s conviction and ordering a new trial under Federal Rule of Criminal Procedure 33, and any other and future orders that the court deems just and appropriate,” says the motion presented.

However, prosecutors and Judge Cogan will have to review the evidence and arguments presented to determine whether or not to overthrow the guilty plea.
This request was presented 3 months after the sentencing of the former official of the then-president of Mexico, Felipe Calderón.
The hearing is scheduled for March 1, although Judge Cogan has pushed back the date twice.
García Luna was found guilty of five charges, which are: participating in a continuing criminal enterprise; international conspiracy to distribute cocaine; conspiracy to distribute and possess cocaine; cocaine importation conspiracy, and making false statements to the United States immigration authority.
During his trial of more than four weeks, 26 witnesses participated, including some criminals such as Jesús “El Rey” Zambada, Sergio Villarreal, El Grande”, and Óscar Valencia, “El Lobo”, who, by the way, regained his freedom this month.
Some of the statements accused García Luna of receiving bribes from the Sinaloa cartel, alerting drug traffickers of security operations, and fighting rival organizations.
