After the Covid-19 pandemic, many people adopted working from home or home office due to its benefits for both workers and companies, which is why in Mexico, including Yucatan, legislation was implemented to regulate this practice.
In this way, next Tuesday, December 5, NOM 037, better known as the Home Office Law in Mexico, comes into force, in which employers throughout the country will have to guarantee the labor rights of team members who work at distance.
The Home Office Law was published in the Official Gazette of the Federation (DOF) on Thursday, June 8, 2023, and becomes official on Tuesday, December 5.
This includes a series of responsibilities that companies and bosses will now have with people who work 40 percent of their time remotely.
New Standard
These are the statements that appear in the new Official Mexican Standard:
Employees must receive a payment proportional to their work expenses such as internet consumption, electricity, computer, tablet and telephone.
Emphasis is placed on the right to comply with working hours and not participate in any activity outside of hours, on vacations, permits and licenses.
Workers must have an adequate environment to carry out their work.
It is mentioned in this Standard that the levels of safety, health, ventilation and lighting available in the work area must be checked.
It should be mentioned that this law applies to workers who have 40 percent of their work at an address other than the workplace.
