Digital nomads in Mexico

Telecommuting is a type of work organization in which the work activity is carried out at the employee’s home or at a place of the employee’s choice. This type of work is becoming increasingly common and its main characteristic is that the employee can do his or her work from a place other than his or her physical office.

The most radical example of remote work are the digital nomads, that is, employees who develop their activity completely remotely, often from cities or countries other than where their company is headquartered, and usually without a fixed residence.

Digital nomads have become popular since the Covid-19 pandemic and represent a growing niche of freelancers, entrepreneurs and businessmen characterized by not having a fixed place of work in the world.

Globally, companies such as Google, Twitter, Kayak, Spotify and Airbnb, have adopted the Work From Anywhere policy, which literally translates as: work from anywhere. According to this new way of working, it is not necessary to be in the office.

The most common jobs held by digital nomads are information technology, creative services, consulting and research, sales and marketing, education, finance and accounting.

However, citizens who can work from anywhere in the world also face several dilemmas such as paying taxes or where to live, so it is necessary that in Mexico there is a legal framework that allows foreigners living in the country to have a paid job outside the national territory, which would encourage the creation of formal jobs.

In view of the above and with the purpose of promoting the attraction of talent, the creation of diverse labor patterns and the generation of legal certainty for this type of workers, I have presented in the Chamber of Deputies an initiative of law for the creation of a legal status called international worker visitor visa.


Through which the foreigner who is in a situation of residence of telework would be authorized to exercise a labor or professional activity at a distance for companies located outside the national territory, by means of the exclusive use of computer, telematic and telecommunication means and systems, with the purpose of remaining for an uninterrupted period of no more than one year, counted from the date of entry.

Let us remember that the constant advance of new technologies, added to the cultural transformation and the adaptation of societies to a new reality, provided the perfect ground for new work models to emerge and be implemented.

For this reason, it is also essential to update the corresponding legislation in order to avoid the existence of legal loopholes that may harm both foreigners who decide to work remotely from Mexico, as well as Mexican citizens who are adapting to the growing presence of foreigners in our country.
