Mayaland hotel seized in Yucatan for investigation against owner

The Yucatan State Attorney General’s Office, in coordination with its counterpart in Quintana Roo, executed the seizure and seizure of the Mayaland hotel, located in the municipality of Tinum, whose owner is Fernando Eugenio Barbachano Herrero, who is being investigated for the crimes of fraud and dispossession to the detriment of Yucatecan businessman Rodolfo Rosas Moya.

SSP.- In compliance with a request for collaboration by the Quintana Roo Prosecutor’s Office, Yucatan ministerial authorities secured the property, located in the town of Pisté, within the archaeological zone of Chichén Itzá.

It was reported that a group of 30 or 40 people tried to take over the facilities of the Hotel Mayaland, located right next to the archaeological site of Chichen Itza.

MÉRIDA.- Dozens of men brought from Quintana Roo in more than twenty vehicles tried to take the facilities of the Mayaland hotel adjacent to the archaeological zone of Chichén Itza, on Friday, February 18th, at dawn.

In the attempt, these people attacked hotel employees and guests and tried to close the property, according to reports of the events.

According to Fernando Barbachano Herrero, owner of the hotel, these people would have been hired by the businessman Rodolfo Rosas Moya, with whom he has a dispute over the possession of the Mayaland.

In September, it was published that Rosas Moya, through his real estate company R4, SA de CV, signed a promise to purchase the Mayaland and The Lodge hotels in Chichén Itzá, owned by the family of Fernando Barbachano Herrero, for a sum of almost 19 million USD.

The purchase-sale promise operation, however, could not be finalized due to last-minute differences between the two businessmen, who initiated a legal process to settle their disputes.

On that occasion, Rosas Moya told the local press that he had confirmed the operation personally, and declared that the transaction was “stuck” because Barbachano Herrero “refused to receive” one of the agreed payments.

In response, Barbachano Herrero replied that due to those delays, the contract was rescinded and Rodolfo Rosas Moya was awarded six million dollars.

 Forbes, from Mexico City, published today on its website that the invasion of the hotel in the early hours of today would be part of the criminal and commercial judicial proceedings, in which law firms from Quintana Roo and Yucatán confronted each other, “giving the beginning of a legal war between Rosas Moya and Barbachano”.

Apparently, Rosas Moya would have filed a complaint with the Quintana Roo Prosecutor’s Office against Barbachano for the crimes of fraud and dispossession and requested the return of his money by commercial means.

Said criminal complaint was filed by exhortation No. 18/2022, derived from an investigation folder carried out by the Prosecutor’s Office of the neighboring state, after which the seizure and seizure of the hotel were ordered, the latter ordered by the second commercial court of Yucatan.

Authorities respond

Through a statement,  the Quintana Roo State Attorney General’s Office reported that personnel from the Yucatan State Attorney General’s Office carried out a diligence at the hotel, located in the town of Pisté, in the municipality of Tinum.

The request of the ministerial authority of Quintana Roo required the insurance of the property.

“In compliance with the law, the staff of the Yucatan Prosecutor’s Office carried out the diligence, which consisted solely of placing seals on the property main entrance, without preventing the entry or exit of tenants or workers.”

“As established by protocol, agents of the Public Security Secretariat went to verify the report, finding that the place at that time was in calm, as corroborated by the person in charge of the security of that site. As soon as any crime is committed, it will be dealt with immediately in accordance with the Law,” the Public Security Secretariat stated.
