CDMX issues guidelines for expropriating land

The Commission for the Integral Reconstruction of Mexico City may promote actions to achieve the expropriation of a property.

CDMX (Agencies) – In a very Bolivarian-Chavista style, the Commission for the Integral Reconstruction of Mexico City -mostly made up of people related to López Obrador’s party, MORENA- will be able to promote expropriations in the country´s capital, after the publication of the “General guidelines for the integration and processing of expropriation” in the CDMX Official Gazette.

The document published by the Legal Department establishes that the “Reconstruction Commission” may promote the necessary actions to achieve the expropriation of a property through a request that determines the origin of the expropriation and the public utility before the Secretariat of Government. The Commission, through the Secretariat of Urban Development and Housing will present the matter before the Real Estate Heritage Committee, and request the Directorate General Legal and Legislative Studies, attached to the Department of Legal Services the preparation and processing of the respective decree.

In order for the decree to be prepared and processed by the Directorate General for Legal and Legislative Studies, the Commission must present an expropriation file. The expropriation file must contain the determination of public utility issued by the head of the Secretariat of Government of the CDMX; the specific agreement of the Real Estate Heritage Committee; the location and area to be expropriated; the physical inspection certificate and photographic report issued by the Directorate General of Real Estate Heritage.

It will also contain the topographical study of the property prepared by the Secretariat of Urban Development and Housing and a tax lien certificate issued by the Public Registry of Property and Commerce.

The file will include the records provided by the Public Registry of Property and Commerce, the accreditation of budgetary sufficiency duly signed by the corresponding authority in order to grant a constitutional compensation.

The expropriation procedure will be initiated and substantiated in accordance with the provisions of the Expropriation Law and other applicable regulations.
